Law is a set of rules that are created and are enforceable by social or governmental institutions to regulate behavior, with its precise definition a matter of longstanding debate. It has been variously described as a science and as the art of justice. State-enforced laws can be made by a group legislature or by a single legislator, resulting in statutes; by the executive through decrees and regulations; or established by judges through precedent, usually in common law jurisdictions. Private individuals may create legally binding contracts, including arbitration agreements that adopt alternative ways of resolving disputes to standard court litigation. The creation of laws themselves may be influenced by a constitution, written or tacit, and the rights encoded therein. The law shapes politics, economics, history and society in various ways and also serves as a mediator of relations between people.

Legal systems vary between jurisdictions, with their differences analysed in comparative law. In civil law jurisdictions, a legislature or other central body codifies and consolidates the law. In common law systems, judges may make binding case law through precedent, although on occasion this may be overturned by a higher court or the legislature. Historically, religious law has influenced secular matters and is, as of the 21st century, still in use in some religious communities. Sharia law based on Islamic principles is used as the primary legal system in several countries, including Iran and Saudi Arabia.

The scope of law can be divided into two domains: public law concerns government and society, including constitutional law, administrative law, and criminal law; while private law deals with legal disputes between parties in areas such as contracts, property, torts, delicts and commercial law. This distinction is stronger in civil law countries, particularly those with a separate system of administrative courts; by contrast, the public-private law divide is less pronounced in common law jurisdictions. Targeted Killing in International Law is a book about the legality of targeted killing, written by Nils Melzer. It was first published by Oxford University Press in May 2008. The book explores the history of targeted killing, as a government strategy by multiple countries including the United States, the United Kingdom, Israel, Switzerland and Germany; for both military and law enforcement purposes. Melzer argues that directly after the September 11 attacks in the United States, perceptions of the tactic became more positive.

Melzer holds a PhD degree in law from the University of Zürich. His dissertation dealt with targeted killing and the book updates and revises that work. He had earlier written on the subject for Yearbook of International Humanitarian Law in 2006. Melzer serves as a legal advisor for the International Committee of the Red Cross (ICRC). He has lectured at the Master-level at the Geneva Academy of International Humanitarian Law and Human Rights. (Full article...)

Selected biography

Sir Nicholas Fuller (1543 – 23 February 1620) was an English barrister and Member of Parliament. After studying at Christ's College, Cambridge, Fuller became a barrister of Gray's Inn. His legal career there began prosperously—he was employed by the Privy Council to examine witnesses—but was hampered later by his representation of the Puritans, a religious tendency which did not conform with the established Church of England. Fuller was repeatedly in contention with the ecclesiastical courts, including the Star Chamber and Court of High Commission, and was once expelled for the zeal with which he defended his client. In 1593 he was returned as the Member of Parliament for St Mawes, where he campaigned against the extension of recusancy laws. Outside of Parliament, he successfully brought a patents case which not only undermined the right of the Crown to issue patents but accurately predicted the attitude taken by the Statute of Monopolies two decades later.

Returned to Parliament in 1604 for the City of London, Fuller became considered the "leader of the opposition" due to his conflict with the government over policy, fighting the impositions on currants, the patent on blue starch, and opposing the proposed union with Scotland on legal and economic grounds. In 1607, in what became known as Fuller's Case, he again began challenging the Court of High Commission, and eventually got the Court of Common Pleas under Sir Edward Coke to agree that the common law courts had the power to free imprisoned ecclesiastical prisoners. These encounters with the ecclesiastical courts were described as "bruising", but by 1610 he was considered an "elder statesman", introducing bills on ecclesiastical reform and the statutory management of customs duties. The Territorial and Reserve Forces Act 1907 (7 Edw. 7. c. 9) was an Act of the Parliament of the United Kingdom that reformed the auxiliary forces of the British Army by transferring existing Volunteer and Yeomanry units into a new Territorial Force (TF); and disbanding the Militia to form a new Special Reserve of the Regular Army. This reorganisation formed a major part of the Haldane Reforms, named after the creator of the Act, Richard Haldane.

The lessons learned during the South African War of 1899-1902 had reinforced the idea that the Regular Army was not capable of fighting a prolonged full-scale war without significant assistance; almost all regular units in the United Kingdom had been deployed overseas within four months of the outbreak of hostilities. Furthermore, by the end of the first year of fighting, the Regular Reserve and the Militia Reserve had been entirely exhausted. (Regular reservists were members of the Regular Army who had retired from the active-duty portion of their service but remained available for the callout. The Militia Reserve was a pool of individuals within the Militia, who accepted an overseas service liability). There had been no thought before the war about the wider use of auxiliary forces overseas; in the event, volunteers had been used on an ad-hoc basis, and a new auxiliary arm (the Imperial Yeomanry) was formed to provide specialist troops, but it was clear that a more effective system was required in future. A number of attempts at reform under the Conservative government of 1901-1905 had failed to make any lasting changes to the system and left the auxiliary forces disorganised and demoralised.

Despite his efforts, several groups vocally opposed his approach: first, the National Service League, led by Field Marshal Lord Roberts, and backed by retired senior officers and some Conservative MPs. They argued that auxiliary forces would be ineffective against Continental armies, even, at one point, enlisting the support of the king. At the same time, the Labour Party members generally opposed any increase in military strength. Further opposition came from protagonists of the existing system, especially the militia. In the face of all these forces, Haldane made a series of last-minute changes to the bill when he presented it in March 1907, including restricting compulsory service to Home defence only. Nevertheless, the structure remained much larger than was likely to be necessary for home defence and included all the supporting arms and services for the planned fourteen full divisions and he commented that 'they could go abroad if they wish.' The bill was put before the Commons on 4 March, then debated in late March and throughout April, where it received prolific but disorganised opposition, mainly from partisans of the existing system. It had its third reading in June, passing with a comfortable majority, and received the Royal Assent in August; the Act became effective immediately, though the bulk of its reforms were scheduled to begin on 1 April 1908. Case law, also used interchangeably with common law, is a law that is based on precedents, that is the judicial decisions from previous cases, rather than law based on constitutions, statutes, or regulations. Case law uses the detailed facts of a legal case that have been resolved by courts or similar tribunals. These past decisions are called "case law", or precedent. Stare decisis—a Latin phrase meaning "let the decision stand"—is the principle by which judges are bound to such past decisions, drawing on established judicial authority to formulate their positions. Ashford v Thornton (1818) 106 ER 149 is an English criminal case in the Court of King's Bench which upheld the right of the defendant to trial by battle on a private appeal from an acquittal for murder.

In 1817, Abraham Thornton was charged with the murder of Mary Ashford. Thornton had met Ashford at a dance and had walked with her from the event. The next morning, she was found drowned in a pit with little evidence of violence. Public opinion was heavily against Thornton, but the jury quickly acquitted him of both murder and rape.

Mary's brother William Ashford launched an appeal, and Thornton was rearrested. Thornton claimed the right to trial by battle, a medieval usage that had never been abolished by Parliament. Ashford argued that the evidence against Thornton was overwhelming and that he was thus ineligible to wage battle.

The court decided that the evidence against Thornton was not overwhelming, and that therefore trial by battle was a permissible option under law. Ashford declined the offer of battle, however, and Thornton was freed from custody in April 1818. Appeals such as Ashford's were abolished by statute in 1819, and with them the right to trial by battle. (Full article...)
